Terms of use

Last updated

By using this site you accept these terms. If you buy something, the shipping, returns and condition policies apply as well; if you consign or ask for a valuation, those terms and your signed agreement apply.

Who we are

JupiterTCG is a dba of Jupiter Coastal Media LLC, Jupiter, FL. No public storefront. Collection services by appointment only.

  • There is no shop to walk into and no published street address. The business address is on file with the state.
  • Collection appointments happen in public places, in daylight, by arrangement. We do not visit homes.
  • We do not accept cards by mail. Nothing is valued, bought or consigned sight-unseen.

We reply within 2 business days. Every submission gets an answer from a person, including the ones we decline.

Using the site

Use it to look at cards, buy cards, and submit a collection. Do not scrape it, do not try to break it, and do not submit anything you do not have the right to sell.

The images, text and layout on this site are ours. You are welcome to link to any page. You are not welcome to republish our card scans as your own listings.

Every listing is one real card

Each listing is a single physical card we have in hand, scanned as it is, unless the listing says it is a lot. When it sells, the page stays up and is marked sold, so a link to it always leads somewhere rather than to a dead page.

The same card may be listed at the same time on other marketplaces and can be sold in person at an appointment. It stays available here until a checkout completes, and putting it in your basket does not hold it.

That means a card can very occasionally sell twice within the same minute. If a card in your order is one of them, we refund what you paid for that card without you having to ask, and we tell you which card it was rather than waiting for you to notice. If it was the only card in the order, the whole order is refunded, postage and tax included. Anything else you bought is unaffected and still ships. We will not substitute a different card.

Prices and errors

Prices are in United States dollars and exclude tax and shipping, which are shown before you pay. Florida sales tax is collected where required.

Card prices move, and a price can change between the day you see it and the day you come back. The price at checkout is the price; if it has moved since you added the card to your basket, we show you the new one before taking payment rather than charging you either figure quietly.

Very rarely a listing carries an obviously wrong price - a decimal point in the wrong place. We may cancel and refund an order placed against an obvious error rather than fulfil it, and we will tell you why.

Payment

Store payments are taken by Stripe on its own checkout page. We never see your card number. Orders ship after payment clears.

Payments at an appointment, when we buy a collection from you, are made in person on the day. The methods available are listed on the Sell page.

What we do not promise

The site is provided as it is. We work hard on accuracy but we cannot promise that every listing, estimate or availability figure is free of error at every moment, and we cannot promise the site is always reachable.

Nothing on this site is investment advice. Card values go down as well as up, and nothing we publish is a prediction of what anything will be worth later.

What we say about an item - the grade we give a card, and the words we choose - is our honest opinion of the thing in front of us, not a guarantee. The pictures are different: they show the item you will actually receive, and they are the description a return is judged against. The condition policy explains how a grade is reached, and why two careful graders can land one step apart on the same card. If we got it wrong, that is a return under the returns policy, which says what is covered and how.

This is the limit of what we owe. If something goes wrong with an order, the most we can be liable for, whatever the claim is called, is what you paid us for that order. That is a ceiling on everything arising out of that order taken together, not a ceiling for each card in it. Where an item is not as described, a return under the returns policy is the remedy, and a refund is the only remedy we have; if a card stays with you rather than coming back, we cannot owe more than what the flaw took off its value, and never the whole price. A card we have refunded in full is ours again. We pay the postage both ways - we send you a label - and you send it back within 14 days of us asking. Knock-on losses are not covered at all, whatever a card turns out to be worth:

  • What a card might have been worth later, or what you hoped to make on it.
  • A sale, a trade or a deal of your own that fell through.
  • Grading fees, submission costs, travel, or your time.
  • Lost profit, lost opportunity, and any other loss that follows on from the first one.

Those exclusions do not depend on your having bought anything. Whatever the claim is about - something you read on this site, or what we told you a collection was worth in person - knock-on losses are not covered. What we tell you outside a written valuation - across a table, or in reply to the photographs you send, the free first look included - is our opinion on the day and not a report you can hold us to; if you want a figure in writing, that is a paid valuation and the valuation terms cover it.

All of this applies as far as the law allows and no further. It does not cover fraud or deliberate wrongdoing on our part, and it does not take away a right Florida law does not let you give up. If a court decides one line here reaches too far, that line goes and the rest stands. And none of it cuts down money we have said we would pay you: a refund, and the return postage where we have said we will cover it. That is your own money coming back rather than damages, and it counts towards the ceiling above rather than sitting on top of it, whether we have paid it yet or not.

If something goes wrong

Email us first. We would far rather sort it out directly than through anyone else.

That first email is a condition of these terms, not a courtesy. You have to send it and give us a fair chance to put the problem right before you file anything. Most of what goes wrong here is a shipping label or a misread scan, and once we have pulled the order, the scans and any tracking there was, we will either fix it or tell you plainly that we will not. Where we are waiting on a carrier to decide a claim, that takes weeks rather than days and we cannot settle it before they do. Waiting on a carrier is not a refusal. You have given us that fair chance once we have told you we will not put it right, or once a carrier claim we were waiting on has come back.

If that does not settle it, any claim goes to a court in Palm Beach County, Florida. That is where this business is and where the cards, the scans and the records are kept. You agree that the state courts sitting in that county, or the federal court that covers it, may hear the claim, and that it has to be brought in one of them and nowhere else. That binds us too. Small claims court there is quick, it is cheap, and it does not need a lawyer on either side.

Two things go with that, and they bind us exactly as they bind you. A claim is brought on your own behalf: not as a class action, and not bundled together with other people. And neither of us asks for a jury. A judge hears it.

There is a deadline as well. A claim about an order has to be brought within one year of the day the order shipped, which is the date we record on every order and will tell you on request. Where we were waiting on a carrier, the time that took does not count against the year. A year is long enough to look at a card and say something is wrong with it, and about as long as the argument can fairly be kept open: a carrier closes its own claim window long before then, and a card that has been somewhere else for a year has been handled, stored and moved by people who are not us. If a court decides one part of this section does not hold, the rest of it still does.

These terms are governed by the law of the State of Florida.

Changes

We may update these terms. The date at the top of the page changes when we do, and the version in force when you placed an order is the one that governs it.
